Any request for a hearing shall be made in writing on a form provided for that purpose. The request must be received by the Chief of Police within 10 days of the receipt of notice from the registered tow truck operator that effected the impoundment together with an administrative hearing fee pursuant to Chapter 3.35 PMC. If the hearing request is not received by the Chief of Police within the 10-day period, the right to a hearing is waived and the registered owner is liable for any towing, storage, or other impoundment charges permitted under this chapter.

Only upon a showing of good cause will a late request for a hearing be considered. For the purpose of this section, “good cause” shall be defined as circumstances beyond the control of the person seeking the hearing that prevented such person from filing a timely request for hearing. In the event such extension is granted, the person receiving such extension shall be granted a hearing in accordance with this chapter. [Ord. 3796, 2006; Ord. 3405 § 1, 2000; Code 1970 § 10.18.032.]
