Nothing in this section prohibits a law enforcement officer from issuing a notice of infraction to a person in control of a vehicle at the time the violation occurs:

(1) When the infraction is committed in the officer’s presence (except as provided in RCW 46.06.485);

(2) When the officer is acting upon the request of a law enforcement officer in his presence of the traffic infraction committed; or

(3) If an officer investigating at the scene of a motor vehicle accident has reasonable cause to believe that the driver of the motor vehicle involved in the accident has committed a traffic infraction pursuant to RCW 46.63.030(1)(a) through (c). [Ord. 4392 § 1, 2018; Code 1970 § 10.22.070.]
