(1) An applicant shall apply for a vacation by submitting the following:

(a) A vacation petition upon forms provided by the City;

(b) A legal description of the area to be vacated prepared by a licensed surveyor when requested by the City, or except as provided in PMC 12.40.110;

(c) For each petitioner, a title report indicating ownership and providing a legal description of the property owned by the petitioner unless waived as provided in PMC 12.40.120(2);

(d) The vacation application fee as provided in PMC 3.35.110;

(e) A signed agreement to pay the cost of an appraisal unless waived as provided in PMC 12.40.120(2); and

(f) Any additional information or material that the Director of Community and Economic Development determines is reasonably necessary for the City Council to consider the requested vacation.

(2) The petition shall be filed with the Director of Community and Economic Development, and the petition shall be signed by the owners of more than two-thirds of the property abutting upon the street or alley (based on front footage), or underlying the public easement (based on square footage).
