(1) In order to promote the most efficient use of the City’s domestic and irrigation water supplies and systems, the utilization of irrigation water in lieu of domestic water for single-family residential properties is strongly encouraged and payment for water is required, regardless of use, when such service is available.

(2) The City Manager is authorized to allow an exemption from the requirement in subsection (1) of this section (the monthly irrigation service charge) for individual property owners who document their nonuse of the irrigation utility prior to September 1, 2002, and who remain nonusers of the system. Such property owners will be required to enter into an agreement with the City which sets forth the conditions of the exemption. The exemption is nontransferable and shall expire upon sale or disposal of the property. Such property owners shall pay an annual system availability fee, representing a proportionate share of the fixed capital costs of the irrigation utility, as set forth in Chapter 3.35 PMC.

(3) In cases where irrigation water is available and not utilized and a backflow prevention device is required for protection of the City’s domestic water supply, all such costs associated with installation, maintenance and testing of the backflow device shall be the responsibility of the property owner.
