Irrigation water for properties, other than single-family residential, shall be made available at the discretion of the Director who shall consider the following constraints of the utility in making such determinations:

(1) Legal – whether there are sufficient and applicable water rights available to the utility to service the subject property;

(2) Operational – whether the utility can provide the water in such a way that existing customers will not be adversely affected;

(3) Physical – whether the storage, pumping, transmission and distribution facilities of the utility are sufficient to supply irrigation water to the subject property. [Ord. 3679 § 3, 2004; Code 1970 § 13.61.065.]
