(1) Right-of-Way Use Permits. Within 90 days after receiving a complete application for renewal, the City Engineer shall issue a written determination granting or denying the renewal application in whole or in part. If the renewal application is denied, the written determination shall include the reasons for nonrenewal, including:

(a) The continuing capacity of the public ways to accommodate the applicant’s existing facilities;

(b) The applicant’s compliance with the requirements hereof and the permit;

(c) Applicable federal, state and local communications laws, rules and policies; and

(d) Such other factors as may demonstrate that the continued grant to use the public ways or City property will serve the community interest.

(2) Franchises. Within 120 days after receiving a complete application for renewal of a franchise, the City shall issue a written determination granting or denying the application in whole or in part. Prior to granting or denying a franchise renewal, the City Council shall conduct a public hearing and make a decision based upon the standards set forth in subsection (1) of this section. Pursuant to RCW 35A.47.040, the City Council shall not approve any franchise hereunder until the next regularly scheduled Council meeting following the public hearing. If the application is denied, the written determination shall include the reason for denial.

(3) Facilities Leases. Recognizing that the City is under no obligation to grant a renewal of a lease for the use of City property, the City shall consider and take action on applications for renewal of a lease within 30 days after receiving a complete application for renewal. When such action is taken, the City shall issue a written determination granting or denying the lease renewal in whole or in part, applying the standards set forth in PMC 15.10.050(3). If the City takes no action on an application for renewal of a lease within 30 days after receiving a complete application for renewal, the lease renewal will be deemed to have occurred automatically.
