15.95.050 Failure to obtain a franchise.

Consistent with the requirements of due process, any person who constructs or operates a cable communications system in the City without first obtaining a franchise as required by this chapter may, in the City’s discretion, be subject to:
(1) Forfeiture, by operation of law, of the person’s cable communication system located in the public rights-of-way that is not authorized by an existing franchise; and/or
(2) A requirement that the cable communication system be removed, at such person’s cost, and that penalties and damages allowed by law be paid. [Ord. 4298 § 4, 2016; Code 1970 § 15.95.050.]
