2.125.300 Permission to remove remains.

The remains of a deceased person may be disinterred from a lot or niche with the consent of the City and written consent of one of the following in the order named:
(1) The surviving spouse; or
(2) The surviving children of the decedent; or
(3) The surviving parents of the decedent; or
(4) The surviving brothers and sisters of the decedent.
If the required consent cannot be obtained, permission by the Superior Court of Franklin County is sufficient; provided, that the permission shall not violate the terms of a written contract or the rules and regulations of the cemetery. [Ord. 3384 § 1, 1999; Code 1970 § 2.48.280.]
