The Director of Community and Economic Development may adjust the standard transportation impact fee at the time the fee is imposed as may be necessary to accommodate unusual circumstances in specific cases to insure that impact fees are imposed fairly.

The amount of the fee to be imposed on a particular development may be adjusted by the Director of Community and Economic Development after having given consideration to studies and other data available to the Director of Community and Economic Development or submitted by the developer demonstrating to the satisfaction of the Director of Community and Economic Development that an adjustment should be made in order to carry out the purposes of this chapter.

The transportation impact fee may provide for system improvement costs previously incurred by the City to the extent that new growth and development will be served by the previously constructed improvements provided such fee shall not be imposed to make up for any systems improvement deficiencies.
