The Department of Community and Economic Development may waive the requirement for a critical area detailed study if there is substantial evidence that:

(1) There will be no alteration of any critical area or within any required buffer;

(2) The development proposal will not impact the critical area in a manner contrary to the purpose, intent or requirements of this title; and

(3) The performance standards required by this title will be met.

In making the determination, the Department of Community and Economic Development will rely on applicable best available science sources.
